Looks like a manufacturing flaw.

You could try to ask BMW for a good will gesture.

yeah that's what i was thinking guess thats one option...this has kind of made me fall out of love with BMW though, i also had the coil pack issue in the first 2 years of my ownership had to have it replaced 4 times as well as replacing the seatbelt arms due to faulting and just generally other faults with the car

Can you not just buy a warranty from BMW? With your mileage it should be pretty cheap...

Well the extended warranty i was quoted for one year is £570 and it would start in a months time so say i bought it today it would start 22nd July 2013 so if my car failed before then then i would be screwed! As it doesnt cover any 'pre-existing' conditions

Also i told them i had no modifications as im sure they wont cover it with modifications despite me not doing anything to the car directly affecting the differential but i imagine they'd come up with BS like "oh you lowered it we wont cover you" etc etc

Interesting that in Mike Miller's maintenance guide (in which regular changing of the diff fluid is recommended) he expresses concern for the longevity of the latest BMW diffs because of (a) the very small quantity of lubricant they now contain and (b) the use of plastic for some of their internal components. Food for thought...

There isn't actually an inspection prior to the warranty starting.

Unless you have identified the problem to BMW, they'd never know.

I would wonder if they would blame the suspension though if they had the chance.

Remember though, it is a private company that provide the warranty. Most dealers would be happy for the work and not mention it.

£570 for a 320i. That is harsh when my 335i was £380 or £390 for the top package.

Why is the 335i the cheapest BMW for insured warranty?

Hmm thanks for the help i guess...i'll just see what happens on monday as my car is going in for a service and i've asked them to investigate the issue...hopefully we can come to some sort of resolution as i feel this is not what a bmw should be like.

i've also had problems with the coil packs had that replaced 5 times by bmw, the seat belt arms and now the diff...kinda annoying like i said wouldnt expect this from BM since i've also got a T-reg e39 which is an absolute dream and has never once gone wrong in the 15 years of ownership (first owner)!

My diff failed last week (completely cracked into peices) on my 320i. 75k miles.

BMW wanted 2k for a new one and fitting. So i bought a second hand one off ebay and got it fitted. Cars been fine since and the horrible wine has gone.

If you need any advice let me know, it was very hard to get the correct ratio which is 3.64 for your car thats the only thing.

mine is a 57plate 3.64 ratio e93 and part no is 7519925 but i think realoem shows it as 7519926. Cost me £750 all in for second hand diff, oil and fitting.

JordanE93 might need your help mate as i had my service done by bmw which was for brake fluid and vehicle check and after arguing with the dealership btw Synter Chigwell which up until now i recommended but no longer! They turned around and said "oh because you have spacers and changed the wheels (my wheels are the exact same size as my original mv4 225m's) we wont do the goodwill gesture repair so it's going to be £2000". After explaining to them it was unacceptable etc and getting a good enough discount off of my service i just said i'll be taking it up with BMW AG, so i'm going to call them tomorrow morning.

As for you Sam the signs that i had were when i would go over say 40mph ever so slightly increasing my speed i could hear a sort of whistling whining noise coming from the back of the car. I got my mechanic to check it out and the oil was leaking and as the story goes above we found out it was cracked!

Anyway i'll update you guys as to what BMW AG say tomorrow, the dealer was saying though whether BMW do it for free or not if you're getting it done by BMW it has to go back to the factory?! If he meant Germany or somewhere in the UK im not sure but if it is Germany then that's just hassle!

Oh and mine is June 2009 Build...didn't get a chance to get the oem number on the diff though

Symptoms of my diff going was a loud 'clunk' pulling away on take-up of drive. Fortunately had an aftermarket warranty (RAC) that met the full cost (about £1600 as I recall). BMW do not supply internal parts for diffs, only full replacements.

Sounds like it would be cheaper to get a new quaife limited slip diff from Birds BMW?

Have you tried any breakers yards?

Birds dont seem to have one for a 2009 320i automatic?

I would phone Birds direct, explain your situation.

They will for sure be miles cheaper than any dealer and may even be able to help source parts or used diffs instead of the whole diff and casing.
