Yesterday at 6:33PM going South down the Dallas North Tollway a trailer towed by a truck going North on the opposite side was not hitched properly. The trailer (12 feet long) came unhitched, Flipped up, hit the barrier and almost tipped over onto the fast lane on the other side which would have resulted in the 335 and I being crushed on the tollway. As this happened A 335i followed by me were passing. The 335 slammed on his brakes as I did too. Unfortunately his brakes stopped him much faster then mine could as I tried to slow down I rammed into his rear bumper going around 40. The only thing that stopped the trailer was a light pole standing on the barrier. The light poles lamps fell off into traffic and the steel pole was bent into an "S" shape. As the steering wheel air bag deployed my car was filled with smoke and debris. I came too and realized I was still rolling forward, I stepped on the brake and put the car into park. Not thinking I got out of my car, threw a middle finger up to the man with the flipped trailer that is now on its side blocking 2 lanes of traffic. I walked up to the man with the 335 and asked if he was okay. I then did a walk around and saw I was also hit behind on my back bumper which is why my right side curtain airbag went off. A woman and her baby had nearly clipped my rear while trying to avoid the wreck. They were shaken but okay.

Im sure my car may be totaled, though the frame was untouched but everything above the frame was crushed (grilles, radiator, headlights ) So if the frame is not twisted I may just repair the car since I put so much work into it.

My hood is bent in half, my radiator is ruined, coolant spilled all over the highway, I have little left of my front bumper and my front fenders are a little bent up. For the most part the car held up good especially with the speed I was going on impact.

I see that all the time with trucks not properly holding down their cars. At least you're ok, is that truck driver's insurance paying for everything?

There's been way too many "final destination"-type posts popping up lately. Hurts my soul when I hear about people (especially e90'ers) getting hurt and their cars wrecked.

Damn, this has to be one of the craziest sounding e90 wrecks I've seen on this site. I'll be checking back later for these pics. Sorry about the wreck, though. Personally I'd take the totaled money you will get and invest in a car you like even better. Turn a bad situation into a good one.

Wow, glad you're ok. That must have been scary as hell. I'm not sure how the insurance will play out. If the 335i was able to stop without hitting anything (doesn't appear the trailer actually crossed over the median) and you struck it hard in the rear, fair or not, his insurance company may go after yours claiming you failed to follow at a safe distance. That's almost an automatic win for insurance companies.

I was following at least 3 car lengths behind. Not the furthest away but not tailgating either. The Tollway was packed because it was rush hour. I couldn't even make the swerve to miss him because I would have slammed into another car in the lane next to me. I had no option. I made sure he knew that I really had no other choice. I tried to stop but couldn't. He went from highway speeds to 30mph in what seems like seconds and my car just couldn't slow down in time from speeds like that.

Glad that everyone is physically OK.

This is obvious, but if you haven't already contacted your insurance company do so ASAP. Let them sort everything out with the truck driver's insurance - it's a service they provide that's worth taking advantage of, as you avoid the headaches of negotiating with the truck's insurance company yourself. Also, be sure to provide them with the accident investigation report - this will document that the cops have not cited you for speeding or following too closely (which is a defense the other insurance company will try to throw at you).

The standard used to be one car length for every 10 MPH but now most states (including Texas) have adopted the "2 seconds rule". So the distance has increased from 6 car lengths at 60 MPH to 9 car lengths. I'm not criticizing you -- few people, myself included, maintain a safe distance between themselves and the car ahead, and even if one tries, someone will invariably cut into the "opening". I'm just saying that there's a good chance the other guy's insurance company will use it to their advantage. By your own admittance, you were following too close to stop.

Completely a shitty deal, but because his trailer didn't actually hit your car or the 335i, you might be a related but separate accident. The accident was no doubt caused by his trailer hurtling towards you two.

Also, I am sure your tinted tail lights did NOT help the cars behind you see your brake lights any better. You should really fix that.

They are vinyled, it was already cloudy out and you could see my brake lights fine. Its tinted but the light is almost just as bright as before.

glad you're okay, but from what don't know how they'll judge it since the trailer didn't cross the divider, no contact, and following distance if they have it on record. did lady behind hit you before you hit car in front?
