My car may be a lemon!?

I am considering lemoning my car. During the time I have had the car it has been in the dealer 2 seperate times for the brakes squeak, 2 times for the fuel pump replacement and now my doors will not unlock! On top of that I feel my car not up to par in performance.. possibility of another fuel pump failure..... This is getting ridiculous, my car was fine up until 26,000 miles and bam.. 2 fuel pumps with in a month and now my doors are stuck in the locked position!

You cannot lemon this car, it's got too many miles on it.

A special provision, often called the "Lemon Law," helps determine what is a reasonable number of repair attempts for problems that substantially impair the use, value, or safety of the vehicle. The "Lemon Law" applies to these problems if they arise during the first 18 months after the consumer received delivery of the vehicle or within the first 18,000 miles on the odometer, whichever occurs first.

I have 26k miles and I think the fuel pump is going. What were ur symptoms? I am bringing the car in today.

Important Consumer Notice: Arbitration is not a requirement for consumers in California to pursue a lemon law claim/case against an automobile manufacturer. Additionally, your lemon law rights extend to the entire new vehicle limited warranty period, which is typically 3 years/36,000 miles, or 4 years/50,000 miles. Don't be mislead by "information" or "instructions" or manufacturer's "lemon law booklets" that a lemon law claim must be filed within 18 months or 18,000 miles, or that you "must" go through Arbitration - this is simply not the case in California! Our lemon law offices will give you all the information you need on how to pursue a lemon law case to get your money back, or a new replacement vehicle.

Hey im reachin! I know its probably crap, but possibly worth a try.

Even though it sucks having to take this car in numerous times I would never get a Lexus instead...

You can look up your state lemon law online for free and see if you qualify. If you are really considering it, call a Lemon Law lawyer who gives free consultations (most of them I imagine) and find out for sure.

I just talked to BMW NA, nothing yet. As my car has only been in for the fuel pump twice and has a total of 9 days in all services(not including scheduled visits). But if my pump fails one more time they advised me to call them back and we'll go from there.

It does not sound like you qualify. Normally the lemon law refers to a long term problem they are unable to fix. Your problems would not be considered anywhere near a lemon situation especially with 26,000 miles.

RambleJ,

All of the members who said your car does not qualify for the lemon law are correct, HOWEVER, there are other warranty laws that you do apply for which will still get you out of that car. Look up "Magnuson Moss Act" and you'll know what I'm talkin about.

My understanding is that you can lemon the car (CA Lemon Law), within it's warranty period for the same occuring problem. If the problem varies with each trip to the dealer then it does have to be within a given time period...(I'm not sure what this is...12 or 18 months from purchase - or something similar.) You can check with California Lemon Law Attorneys...it's worth th shot to ask if you're having so many problems. For me, it was worth the fee to have them do EVERYTHING...all you have to do is submit the required paper work. No hassles with the dealer or BMWNA. They do EVERYTHING! Good luck, either way.

yeah he can lemon it. My friend had an Audi w/ 24k miles on it. Still was able to lemon the car.
As long as it still has the manufacturer warranty, you can lemon the car. Otherwise, what' the purpose of having a warranty? Only to repair a car? big deal.

So lets see.... The breaks squeak. Which everybody says is pretty normal on the car. The HPFP has problems, and has an extended warranty. The door actuators stopped working and had to be replaced. Something that actually does occur somewhat often. Thats why you have a real key. Really doesn't sound too bad.
