Exclamation Speeding Ticket...HELP!!!

ok..here it goes....

Well i was on my way back to NYC after taking a vacation down to NC...and as i was Flying thru the I-295..i pass by a pole looking thing that seemed like a police gadget...so i slow down and before i know it......i see a cop car just come out of no where off the side of the highway wit flashing lights and all...So i pull over thinking that it cant be for speeding since he just pulled out of nowhere....but

He gave me a juicy ticket for SPEEDING!!!! 77 in a 50 zone!! $200 ticket and 5 points!! DAMN IT!!! As i read the fine....they got me using LIDAR ENFORCEMENT which my radar detector did NOT pick up..wft?!?!?
on the side of the ticket he wrote
PL 26109
862.4 FT
any one knows what that means?!?



So i need help... what would be my best option?!?! any advice would be greatly appreciated!!! btw i live in NYC!!

most likely its the radar no.# and the position where he got you.
The gun must be certified to be use in Courts, having those information is usefull if you are to contest the gun as uncalibrated.

haha i got busted last week too, i'll see u in court...mine was potentially much worse, 154 in a 60...but he let me go with just 80 in a 60

Sweet Jesus! 154....how do you get that talked down to 80 in a 60...I sure hope it didn't involve the cornhole.

If you're taking it to court, might not hurt to do some follow-up research on these inherent limitations of LIDAR, as I'd guess this technology is in its relative infancy with respect to law enforcement uses.

nah no corn hole, i just told the cop the bimmer was riidng my ass so i sped up to gte out of te way...i'll fight it in court, hopefully get drive'rs ed or soemtehing

5 points for going 77 in a 50 zone? Sounds a bit harsh. Most people in L.A. drive around 80 mph on the freeway.

As others have suggested, speak to an attorney if traffic school is not an option. It may save you on insurance costs down the road.

thanx for the help fellaz...

i dont know how the cop could have caught me using a "Gun" as he flashed his lights and pulled out of a ditch way before i got close to him....usually they get ur speed after u pass them...then follow you...but this dude just pulled out of nowhere...i was surprised as my detector did not go off......i assume they use new technology using a post or something that checks ur speed and sends signals to an awaiting police car up ahead......WAT A SURPRISE!!

but i think im just gonna pay off the $200 and call it a day...last time i checked...points dont transfer from other state tickets...so if thats still applicable..then i really have nothing to worry about!! i have gotten 2 other similar tickets in NC and VA over the past 3 years and i still have my license....

You might want to check on the points. It seems usually neighboring states transfer points.

That is the agreement under which states share information and transfer points. New York is one of just 5 states that only transfers points for "major" violations (lucky you). I don't know if your ticket qualifies as "major."

Within the first half mile of entering the Commonwealth of Virginia there is a sign on the right with white letters on a black field that states that RADAR Detectors are illegal.

Motor Vehicle Code of Virginia

§46.2-1079. Radar detectors

A. It shall be unlawful for any person to operate a motor vehicle on the highways of the Commonwealth when such vehicle is equipped with any device or mechanism, passive or active, to detect or purposefully interfere with or diminish the measurement capabilities of any radar, laser, or other device or mechanism employed by law-enforcement personnel to measure the speed of motor vehicles on the highways of the Commonwealth for law-enforcement purposes. It shall be unlawful to use any such device or mechanism on any such motor vehicle on the highways. It shall be unlawful to sell any such device or mechanism in the Commonwealth. However, provisions of this section shall not apply to any receiver of radio waves utilized for lawful purposes to receive any signal from a frequency lawfully licensed by any state or federal agency.

This section shall not be construed to authorize the forfeiture to the Commonwealth of any such device or mechanism. Any such device or mechanism may be taken by the arresting officer if needed as evidence, and, when no longer needed, shall be returned to the person charged with a violation of this section, or at that person's request, and his expense, mailed to an address specified by him. Any unclaimed devices may be destroyed on court order after six months have elapsed from the final date for filing an appeal.

Except as provided in subsection B of this section, the presence of any such prohibited device or mechanism in or on a motor vehicle on the highways of the Commonwealth shall constitute prima facie evidence of the violation of this section. The Commonwealth need not prove that the device or mechanism in question was in an operative condition or being operated.

B. A person shall not be guilty of a violation of this section when the device or mechanism in question, at the time of the alleged offense, had no power source and was not readily accessible for use by the driver or any passenger in the vehicle.

C. This section shall not apply to motor vehicles owned by the Commonwealth or any political subdivision thereof and used by law-enforcement officers in their official duties, nor to the sale of any such device or mechanism to law-enforcement agencies for use in their official duties.

D. No demerit points shall be awarded by the Commissioner for violations of this section. Any demerit points awarded by the Commissioner prior to July 1, 1992, for any violation of this section shall be rescinded and the driving record of any person awarded demerit points for a violation of this section shall be amended to reflect such rescission.

i got pulled over for speeding (73 in a 55) in MD and 2 points --- anybody know if points transfer from MD to VA? Any ideas to waive the points w/o having to go to court?
