Rejecting my car
As the title says I'm on the verge of rejecting my car. Has anyone else done this, and if so was it easy. I've had the car 5 months and the dealer still cannot fix the juddering issue. I've e mailed Bmw customer service, and surprisingly they have ignored me.
Any help would be appreciated Thanks |

My friend a solicitor has rejected a car.
What exactly is the issue with your car? What has been done about it to date. You need to have a very clear fault that has not been sorted out. Having had the car for 5 months makes it difficult, as it suggests the car is useable. |

Not had dealings with BMW in this way, but I tried it with Audi as I wasn't happy with my A4 Avant, Audi got involved and I was offered a replacement A6 FWD 2.0 tdi S line as a replacement to my A4 2.0 TDi Quattro Dynamik. As the A6 had no spec on it I said no, and my only option was to argue with the sales manager, take a 2k loss, and kick the car into touch.
I find out this year that the VW group announce what I complained about 4 years ago with the EU5 engines! I should make a claim to Audi for the 2K loss given the car was not fit for purpose, but I'm not sure that's worth the hassle! |

Since collecting the car when I accelerate onto the motorway the car seems to miss fire. The whole car shakes, as if I was lifting on and off the power. The car shows no fault codes and it's been into the garage 5 times. They have felt the fault but have told me to let it develop!!!!

If you can clearly document the dates on which the car has been back to the dealer, and can demonstrate that the problem has not been fixed, you should still have grounds for rejection under the Sale of Goods Act. Clearly this is not a typical nor acceptable running characteristic for the car.
If you persevere in getting it resolved it may, perversely, build good rapport with the dealer. My UAC has been back to the dealer many times - the service manager understands the hassle it has caused, goes out of his way to continue to resolve recurring faults (mainly suspension knocking), and has provided compensation as goodwill.

Any way to cut a long story short it went back and forwards to the bodyshop, five times and every time I said that I wasn't happy with the quality of the repair, they even offered to fit two doors, taken from another new vehicle but I refused that too. Eventually the business manager called me in and said that in cases like mine the dealership can request a replacement vehicle from BMW. I had to put in writing, the fault, the number of times the car had been in to be fixed with as much information, dates etc and he would pursue this. After three to four weeks I got a call to say that it had been agreed that the car would be replaced and did I want the same colour. It took quite a while but you need to be firm and have as much information as possible. Good luck. |

I rejected an Audi TT, took a few months and eventually got a sort of result.
Have to stop using it and a really good source of information is the honest John website and rejecting under the sale of goods act and if you have it under pcp then the consumer credit act too, as the finance company are liable too. Let me know if you need any advice. |

The dealer have to have been allowed three attempts to fit the problem in six months.So you are under the time radar Jonesy.If they fail you can use the sale of goods act.
This is where it get a bit of a grey area. You might not get a full refund as you have been using the car. You might get on better if they offer to swap it.

Also film the car doing this with a gopro or similar and post on youtube. Once you have the evidence clearly set up, write to BMW UK, BMW finance (if bought on finance) and your supplying dealer, with links to the youtube footage, and tell them they have 14 days to respond to this fault other wise you with be consulting with your solicitor and preparing a formal rejection. I will put money on it that they will collect your car and have it back to you in perfect working order. Probably with a set of new injectors. |

Thanks for all the replies. I'm just sending off a couple of emails, dealer, Bmw customer service and Bmw finance. As I've stated the dealer is fully aware of the issue as when they last had the car for 4 days the tech felt it on several occasions. Will keep everyone updated

As BMW Customer Services have ignored you, I would email the UK CEO directly. My experience is this tends to hurry things along...
Graeme.Grieve@bmw.co.uk Tim Abbott has moved on now, but back in 2010 there was a mis-build problem with my F10 and I was getting the run around. He responded within 3 hours and it was resolved within 24 hours. I'm not suggesting this is normal, but definitely worth a try. |

This may not help but my 428i has just broken down with not too dissimilar problem, cutting out juddering etc. No faults reported but it turned out to be a failed injector in the end. The issue with the 'bmw technicians' was that the fault was not being reported though the car yet would not run so clearly they had to accept that there was a fault.
Has your fault been pushed up the line from BMW dealer to the UK wide specialists (there are 6 of them btw).... may be worth pushing your dealer to do this? Hope you get it sorted.... |

I had a similar issue with my 328i. After 6k miles it had to have a new gearbox to fix a noise it was making. Not long after, it developed a misfire rather like yours when accelerating but only if I put it in manual mode and used the paddles, in fully auto mode it was fine. I can best describe it as if the fuel was being rapidly switched on and off. Sadly despite a number of attempts, and an assortment of other problems, they never did get to the bottom of the misfire.
Good luck, really do hope you get it sorted as next to a house, a car is the most expensive thing many people buy and you can do without the stress!

not just bmw's...
but in all the cars i've had over the last 25 years or so.. you get 'good' cars, and you get 'bad' cars. i've had cars over 7 years 180,000 miles and only changed the oil, discs and pads, and put fuel in, never missed a beat. other cars were a litany of problems, once you do major repairs the car is just never the same ime... and BMW have never sucessfully diagnosed a difficult problem for me, ...there's no money in it for them. last one was a 6 month old F30 320d manual i had replaced after 4 weeks. it used to drive ok though noisey for the first few miles, then there was a heavy vibration felt through the clutch pedal.... a 'bmw master tech' said it's a 'diesel engine characteristic'... well having a tingling numb clutch foot after driving for half an hour isn't a bmw characteristic i'd accept. ....swapped it for my current 320i auto. |

I rejected my M4 after BMW could not clarify the fault (cylinder head related). They had the car from October 2014 and I rejected the car in January 2015. I did not even get to drive it! I did not have any problem with the rejection process as BMW could not identify the cause of the fault but it took from March 2015 (when the rejection was finalised) until August 2015 before my money was returned in full...
I sorted the rejection with the Service Director who was very sympathetic and totally agreed with my reasons for rejection. |

If I was CEO, I wouldn't want to be flooded with emails, but I would want to know if the brand was being damaged by silliness. My experience was one of the main reasons I bought another BMW. |

Within an hour of contacting Graeme the sales manager had contacted me as had 2 members of Bmw customer care. We have a meeting on Monday. Let's see what happens.

It's a shame unless you take your complaint to top management, you don't get anything! I had issues couple of time and both time Tim (the previous CEO) got them fixed!
