Rpi scoops problem

I got these scoops a long time ago and I'm just installing now.. I have a 2007 328xi. I installed the scoops now I'm trying to put the piece (black plastic piece that feeds air into filter) back on top but it will not sit flush due to the red tab that sits on top.. do I have to cut a portion of the black piece to make it fit? Will this cause an error in the cars computer?

A picture would help. You shouldn't have to cut anything but I have Cyba air scoops so they might be different.
