Sounds like the EPA is upset about a potential failure to disclose some piece of software that is actually used for emission management......

"The EPA and California Air Resources Board told Fiat Chrysler it believes its undeclared auxiliary emissions control software allowed vehicles to generate excess pollution in violation of the law"

There's no mention of actual empirical evidence to support the "Belief"
