Not that I have a dog in this fight, but VW sold them a car that did not pass US regulatory requirements in force at the time of manufacture of the vehicle (which is illegal just BTW). The manufacturers label on the driver's door pillar states as such, which in essence VW lied about the vehicle meeting all Federal automotive requirements. VW should just give the OP a new vehicle or one comparable to what he currently owns.

I'd be getting a replacement vehicle for free. VW is basically forcing the OP to trade in his car because they fucked up and sold it to him illegally. And people complain about General Motors...

A manual transmission can be set to "comfort", "sport", and "track" modes simply by the technique and speed at which you shift it; it doesn't need "modes", modes are for manumatics that try to behave like a real 3-pedal manual transmission. If you can money-shift it, it's a manual transmission. "Yeah, but NO ONE puts an automatic trans shift knob on a manual transmission."
